Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you.

In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.
 
You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

In no case shall The Mindful Parenting Company, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility. Where liability cannot be excluded, our liability shall be limited to the maximum extent permitted by law.

These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our site.
 
If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).

The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.

SECTION 20 - MISCELLANEOUS
Please follow the instructions on this website to place an order.  Please check your order carefully before confirmation - you are responsible for ensuring that is is complete and accurate.  Please note that signing up to a monthly subscription will generate a recurring monthly payment to us from you, unless you pause or cancel your subscription.  Once you have placed your order, you will receive an email acknowledging your order - please make sure that you check your junk folders - we will not be held responsible for any emails not delivered or missed.  Payment will be taken at the time your order is acknowledged.  Please note that this email does not mean that your order has been accepted - this will take place once we have dispatched your order, at which point the contract between us commences.  
If for any reason (no reason needing to be given), we are not able to fulfil your order, we will email you to advise you of this and we will not process your order, and will refund any monies paid by you as soon as possible.  If there will be an unexpected delay to your order being able to be processed / dispatched, we will email you to inform you and allow you to cancel your order for a full refund or to confirm that you are happy to wait.
We reserve the right to refuse an order or not process a transaction for any reason (no reason needing to be given) at any time at our sole discretion.  
We reserve the right to substitute products within our boxes at our discretion, so long as the substituted products are of similar value and quality.  We also reserve the right to amend the specification of any products if required by any statutory or regulatory requirement.
Where you have signed up to a monthly subscription, it is your responsibility to ensure that your payment details are kept up to date.  Should your payment not be able to be taken or fail (due to an expired debit or credit card or any other reason), we will retry the transaction.  If it remains unsuccessful, we will contact you to request that you update your payment details.  We will not be responsible for any delays in delivery of our boxes, which result from payment not being able to be taken.
We will aim to deliver your subscription box on or just before your baby's monthly birthday, as described in this website.  However, we do not guarantee this but will use our best efforts to do so.  This may not be possible but we will aim to keep you informed at all times if there will be a delay to delivery.  It is your responsibility to ensure that you provide the correct shipping information including address.  We will not be responsible for any goods that are not delivered as incorrect information was provided.  In accordance with our delivery policy, we currently only deliver to England, Northern Ireland, Wales and Scotland.  Orders to be delivered to any other countries will be cancelled and a full refund given.  You may place an order from outside of the UK but we will only accept and deliver to England, , Northern Ireland, Wales and Scotland. We use Royal Mail Signed For service to deliver our boxes, but we reserve the right to change this at any time.  This service includes a confirmation of delivery - at this point the box will be at your risk.  If delivery cannot be made and the goods are taken to the delivery agent's depot, it is your responsibility to collect these in a timely manner or arrange for redelivery as required.
We will take all reasonable precautions to ensure that the contents of our subscription boxes are properly packaged with appropriate wrapping to ensure that they arrive in the condition intended.  However, if on delivery, you find that the products are broken or damaged, you must contact us by email within 3 working days, quoting your order number, details of the damage and also provide any photographic evidence that we may request.
If the contents are damaged, and you have advised us of this in accordance with the above process, we may request, at our discretion, for you to return either all or part of the goods and will arrange for them to be picked up by a courier at our cost.  If you do not make the goods available at the agreed time for collection, we reserve the right to charge you any further costs for collection.
The goods are intended for use only in the UK.  We will not be responsible for ensuring that the goods are suitable for your purposes.  Should you have any questions, comments or complaints about the product, please email us.
The goods are supplied by us for domestic and private use and if used for any other purpose including business or commercial use, we will not be liable for any issues that arise.
Please note that information provided in the monthly information cards or activity cards is general and unspecific in its nature and should not be used as medical or any other professional advice.  If you have any concerns regarding any medical or other issue you should seek professional advice which is based on your or your baby's circumstances / symptoms.
We do not give any representations, warranty or undertakings in relation to the goods supplied, except where noted in these terms.
We will not be liable or responsible for any failure to perform, or delay in the performance of any obligations in our contract caused by events or circumstances outside of our control.  If such an event occurs, we will notify you and advise what effect this will have on our service (e.g. delay to delivery) and we will agree a resolution.
 

We may assign or transfer our rights and obligations under the Contract to
another entity but will always notify you in writing or by posting on this webpage
in the event that this takes place.

You may only assign or transfer your rights or your obligations under the
Contract to another person if we agree to this in writing.

Any variation of the Contract only has effect if it is in writing and signed by
you and us (or our respective authorised representatives).

If we do not insist that you perform any of your obligations under the Contract, or if we do not exercise our rights or remedies against you, or if we delay in doing so, this will not mean that we have waived our rights or remedies against you or that you do not have to comply with those obligations. If we do waive any rights or remedies, we will only do so in writing, and that will not mean that we will automatically waive any right or remedy related to any later default by you.

Each paragraph of these Terms operates separately. If any court or relevant authority decides that any of them is unlawful or unenforceable, the remaining paragraphs will remain in full force and effect.

The Contract is between you and us. No other person has any rights to enforce any of its terms.

This Contract is governed by English law and each party irrevocably agrees to submit all disputes arising out of or in connection with this Contract to the exclusive jurisdiction of the English courts.
